Welcome to Elena Alexander │ Geometric Art. The terms “we”, “us” and “our” refer to Elena Alexander │ Geometric Art. We operate this website and store, including all related information, content, features, tools, products and services to provide you with a curated collecting experience the “Services”. The store is powered by Shopify.
These Terms of Service the “Terms” together with any policies referenced here describe your rights and responsibilities when you use the Services.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

SECTION 1 – ACCESS AND ACCOUNT

By using the Services, you represent that you are at least the age of majority where you live and have the authority to agree to these Terms. You may be asked to provide information such as your email, billing, payment, and shipping details. You represent and warrant that all information you provide is accurate and complete and that you have the right to provide it.
You are responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer or license your account to another person.

SECTION 2 – OUR PRODUCTS ORIGINAL ART ONLY

We sell only original, one-of-a-kind artworks. Quantities are typically one per artwork. We make every effort to present artworks accurately. Colors and appearance can vary due to screens and device settings. We do not warrant that displayed colors or textures will match your device.
Descriptions, availability, and pricing may change without notice. We may discontinue or limit any artwork or service at any time.

SECTION 3 – ORDERS AND ACCEPTANCE

Your order is an offer to purchase. We may accept or decline any order at our discretion. Orders are accepted only after payment is processed and we send a confirmation. Review your order before submitting, as we may be unable to cancel after acceptance. If we decline or change an order, we will attempt to notify you using the contact details you provided.
Purchases are for personal or household use and not for commercial resale or export. Returns and refunds are handled according to our Return Policy.

SECTION 4 – PRICES, TAXES, BILLING

Prices, discounts, and promotions may change without notice. The price charged will be the price at checkout and in your confirmation email. Posted prices do not include taxes, shipping, handling, customs, duties, or import fees unless stated.
Provide current and accurate purchase and payment information and promptly update it as needed. You represent and warrant that you are authorized to use the payment method, and that all charges will be honored and paid.

SECTION 5 – SHIPPING, DELIVERY, AND RISK OF LOSS

We pack artworks using professional materials and ship with tracking. Delivery timeframes are estimates only. We are not responsible for delays caused by carriers, customs, or events outside our control.
Shipments are insured; if a loss or damage occurs in transit, contact us immediately so we can assist with a claim and next steps.

SECTION 6 – RETURNS AND EXCHANGES SUMMARY

We offer a 14-day return window from the date you receive your artwork. To be eligible, the artwork must be in the same condition and returned in original or equivalent professional packaging, with proof of purchase.
Return shipping and insurance are the responsibility of the customer. Items sent back without first requesting a return will not be accepted. Commissions and gift cards are final sale. See full Return Policy for details and EU cooling-off rights where applicable.

SECTION 7 – COMMISSIONS CUSTOM WORK

We accept a limited number of commissions. Commission terms including scope, price, timeline, approvals, and shipping will be set out in a separate written agreement or invoice. Deposits for commissions are non-refundable once work begins. Commissions are final sale and not eligible for return.

SECTION 8 – INTERNATIONAL ORDERS, DUTIES, AND IMPORTS

For orders shipped outside Canada, you are the importer of record and responsible for all customs duties, VAT or GST, brokerage fees, and any other import charges. Policies and thresholds vary by country. Carrier or customs authorities may require additional information to release your shipment.

SECTION 9 – INTELLECTUAL PROPERTY

All content on the Services including text, images, graphics, logos, design, and arrangement is owned by Elena Alexander │ Geometric Art or its licensors and protected by applicable laws. You may use the Services for personal, non-commercial purposes only. No right, title, or interest in the Services or any content is transferred to you.
Our names, logos, product names, designs, and slogans are trademarks of Elena Alexander │ Geometric Art or its licensors. You may not use them without prior written permission.

SECTION 10 – OPTIONAL TOOLS AND FEATURES

We may provide access to third-party tools or features we do not control. You agree that such tools are provided as is and as available without warranties. Your use of such tools is at your own risk and subject to third-party terms. New features are part of the Services and subject to these Terms.

SECTION 11 – THIRD-PARTY LINKS

The Services may include links to third-party sites or materials. We are not responsible for examining or evaluating them and are not liable for any harm arising from your use of them. Review third-party policies before engaging in any transaction.

SECTION 13 – PRIVACY

Personal information collected through the Services is handled under our Privacy Policy. Because our store is hosted by Shopify, certain personal information is processed by Shopify under its policies as needed to operate the Services. By using the Services, you acknowledge these policies.

SECTION 14 – FEEDBACK AND REVIEWS

If you submit ideas, suggestions, reviews, or other content Feedback, you grant us a worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, and display the Feedback for any purpose. You represent that you own or have rights to the Feedback and that it complies with these Terms.

SECTION 15 – ERRORS, INACCURACIES, AND OMISSIONS

Information on the Services may contain typographical errors or inaccuracies, including in descriptions, pricing, shipping charges, transit times, and availability. We may correct or update information or cancel orders if any information is inaccurate at any time without notice, including after you submit an order.

SECTION 16 – PROHIBITED USES

You may use the Services only for lawful purposes. You agree not to engage in any activity that violates laws, infringes rights, harms others, interferes with the operation or security of the Services, or attempts to extract data or content without authorization. We may suspend or terminate access for violations.

SECTION 17 – TERMINATION

We may terminate or suspend access to the Services at any time in our discretion. You remain liable for amounts due through the termination date. Sections intended to survive termination will continue in effect.

SECTION 18 – DISCLAIMER OF WARRANTIES

Except as expressly stated by us in writing, the Services and all products are provided as is and as available without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, durability, title, and non-infringement. Some jurisdictions do not allow certain disclaimers, so the above may not apply to you.

SECTION 19 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, Elena Alexander │ Geometric Art and its directors, officers, employees, agents, contractors, service providers, and licensors shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, savings, data, or replacement costs arising from your use of the Services or any product, even if advised of the possibility. In no event will our aggregate liability exceed the amount you paid for the product that gave rise to the claim.

SECTION 20 – INDEMNIFICATION

You agree to indemnify and hold harmless Elena Alexander │ Geometric Art and our affiliates, partners, officers, directors, employees, agents, contractors, and service providers from losses, damages, liabilities, claims, and expenses including reasonable legal fees arising out of your breach of these Terms or violation of law or third-party rights.

SECTION 21 – SEVERABILITY

If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and the remainder will continue in full force.

SECTION 22 – WAIVER AND ENTIRE AGREEMENT

A failure to enforce any right is not a waiver. These Terms and any policies posted on the site constitute the entire agreement between you and us and supersede prior agreements about the Services. Ambiguities will not be construed against the drafting party.

SECTION 23 – ASSIGNMENT

You may not assign or transfer these Terms or any rights or obligations without our prior written consent. We may assign or transfer these Terms without notice.

SECTION 24 – GOVERNING LAW AND VENUE

These Terms and any related transactions are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict of law principles. The courts located in Calgary, Alberta shall have exclusive jurisdiction and venue.

Headings are for convenience only and do not limit these Terms.

SECTION 26 – CHANGES TO TERMS

You can review the most current version of these Terms on this page. We may update these Terms by posting changes on the website. We will notify you of material changes where required by law. Your continued use of the Services after changes are posted constitutes acceptance.
